Constitutional Court Disposes of Sher Afzal Marwat’s Petition Seeking Sohail Afridi’s Disqualification, Says Petition Has Become Ineffective as He Is No Longer Chief Minister
*Islamabad:* The Federal Constitutional Court has disposed of Sher Afzal Marwat’s petition seeking the disqualification of former Khyber Pakhtunkhwa Chief Minister Sohail Afridi, observing that the petition has become ineffective as Afridi is no longer holding the office.
During the hearing, Chief Justice Aminuddin Khan remarked that, under the current circumstances, the petition had been reduced to an academic and legal question. He observed that if Sohail Afridi is reinstated as chief minister in the future, the petitioner may approach the court with an application seeking restoration of the case.
Sher Afzal Marwat requested a short adjournment, informing the court that he also intended to challenge the imposition of emergency and Governor’s Rule in Khyber Pakhtunkhwa. The court observed that the imposition of emergency and Governor’s Rule was a separate matter, while the petition against Afridi had become ineffective under the prevailing circumstances.
The petition had challenged the resignation of Ali Amin Gandapur and Sohail Afridi’s appointment as chief minister. It sought a declaration that Afridi’s appointment was unconstitutional and requested the restoration of Gandapur to the office of chief minister.
The court disposed of the petition in view of the current circumstances. The order did not constitute a decision on the merits of the allegations seeking Sohail Afridi’s disqualification.
