US Imposes Sanctions on International Criminal Court After Navi Pillay Wins Nobel Peace Prize; Court Had Issued Netanyahu Arrest Warrants

*WASHINGTON:* The United States has imposed new sanctions targeting the International Criminal Court (ICC) as an institution. The announcement came hours after South African jurist and human rights advocate Navi Pillay was awarded the 2026 Nobel Peace Prize. US Secretary of State Marco Rubio announced the measures on October 9, arguing that Washington does not recognise the ICC’s authority to prosecute American citizens or officials.

Under the US measures, certain financial transactions involving the ICC have been restricted, while efforts have been made to limit the court’s access to American financial services, technology and the US dollar-based financial system. US entities have also been given six months to terminate business relationships with the court, with exemptions provided for certain necessary activities.

The US government has justified the sanctions by raising objections to the ICC’s investigations involving American personnel and its legal actions against Israeli leaders. Washington maintains that the court should not exercise jurisdiction over American citizens in cases that, in its view, fall outside its lawful authority. The United States is not a party to the Rome Statute, the treaty that established the ICC.

In November 2024, the ICC issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and then-Defence Minister Yoav Gallant over alleged war crimes and crimes against humanity in Gaza. The warrants were issued by the court’s Pre-Trial Chamber, not by Navi Pillay personally. The Israeli government has rejected the allegations.

The ICC has condemned the US sanctions, describing them as an attempt to obstruct an independent judicial institution and undermine the international legal system. The court maintains that it will continue carrying out its mandate to investigate and prosecute genocide, war crimes and crimes against humanity. Human rights advocates have also warned that the sanctions could undermine efforts to secure justice for victims of serious international crimes.

Navi Pillay was announced as the recipient of the 2026 Nobel Peace Prize on October 9 in recognition of her longstanding contributions to peace and international law. She is a prominent South African jurist who previously served as the United Nations High Commissioner for Human Rights and held judicial positions in international tribunals. The Nobel Committee praised her work to ensure accountability for war crimes, crimes against humanity and genocide.

The announcement of Pillay’s Nobel Peace Prize and the US sanctions against the ICC came on the same day. However, the US government cited its objections to the court’s jurisdiction and its proceedings involving American and Israeli leaders as grounds for the sanctions. Available statements do not establish that the measures were imposed directly because Pillay received the Nobel Peace Prize.
